WESTERN UNION® PARA TRANSFERİ HİZMETİ HÜKÜM VE KOŞULLARI

Bu Para Transferi Hüküm ve Koşulları ( “Koşullar”) altında, bir İşlem gönderdiğiniz ülkede (“Gönderme Ülkesi”) Hizmetlerimiz için bir Western Union Kuruluşu ile iş birliği içinde lisansı kapsamında Hizmetler’i sunan bir Western Union lisanslı bağlı kuruluşu (her biri bir “Western Union Kuruluşu” ve topluca “Western Union Kuruluşları”) veya bir lisanslı iş ortağı, temsilci veya acente (bir “İş Ortağı”) (“Biz”, “Bizim” veya “Bize” geçerli Western Union Kuruluşu ve/veya İş Ortağı anlamına gelir) ile bir sözleşme yapmaktasınız. Hizmetlerimiz için başvuruda bulunduğunuz Western Union Kuruluşu/Kuruluşları veya İş Ortağı ile iş yapmaktasınız. Kuruluş ayrıntıları Ek A – Ülkeye Özgü Hükümler‘de veya Makbuzunuzda yer almaktadır. Varsa Gönderme Ülkesi’ne bağlı olarak sizin için geçerli olabilecek farklı veya ek koşullar Ek A – Ülkeye Özgü Hükümler‘de bulunabilir. Ayrıca bu Şartlar kapsamında olmayan ek finansal hizmetler de sunmaktayız (ör. dijital cüzdan hizmetleri). Bu ek finansal hizmetleri kullanmak için söz konusu hizmet için geçerli ek hüküm ve koşulları da kabul etmeniz gerekebilir.

BÖLÜM A: GİRİŞ

Bu Koşullar, aşağıda tanımlanan Hizmetlerimiz için geçerlidir. Hizmetlerimizi kullanarak bu Koşullar’ı kabul ettiğinizi ve bunlara uymayı kabul ettiğinizi onaylamış olursunuz. Bu Koşullar’ı kabul etmiyorsanız Hizmetlerimizi kullanamazsınız. İleride başvurmak üzere bu Koşullar’ın bir kopyasını yazdırmanızı veya kaydetmenizi öneririz.

Hizmetlerin tamamını veya bir kısmını (herhangi bir üçüncü taraf bağlantısı üzerinden erişim dahil) herhangi bir zamanda ve hiçbir yükümlülük olmaksızın değiştirebilir veya sonlandırabilir; Hizmetlerle ilgili belirli ücretler getirebilir, bu ücretleri değiştirebilir veya bunlardan feragat edebilir; Hizmetleri veya belirli Hizmetleri bazı kullanıcılara veya tüm kullanıcılara sunabiliriz.

I. TANIMLANAN TERİMLER

Aşağıdaki terimler aşağıda belirtilen anlamlara gelmektedir. Tanımlanan ek terimler, ilgili bölümde parantez içinde belirtilir. Bu Koşullar’daki altı çizili sözcükler daha fazla bilgi için köprüler içerir.

“Banka Kartı”, banka kartı veya ön ödemeli kart ve varsa kredi kartı (ör. Visa veya Mastercard) anlamına gelir.

“Fatura Ödemesi”, bazı ülkelerde müşterilerin çeşitli fatura edenlere yapılacak ödemeleri planlama, yönetme ve ödeme olanağı sağlayan bir hizmet anlamına gelir.

“Kartı Düzenleyen”, bir Banka Kartını düzenleyeni ve Banka Kartının sahibini ifade eder.

“Konum”, para transfer edip alabileceğiniz ya da bazı ülkelerde bizimle şahsen fatura ödeyebileceğiniz yerleri ifade eder. Buna bankalar, süpermarketler, finans kuruluşları, postaneler, ödeme kulübeleri ve diğer perakendeciler gibi çeşitli yerler dahildir.

“Mobil Uygulama”, müşterilerin Hizmetleri kullanması için tarafımızca sunulan bir mobil uygulamayı ifade eder.

“Alıcı”, Gönderen tarafından parayı almak üzere tanımlanan alıcıyı ifade eder ve Fatura Ödemesi hizmetinde Fatura Edenleri içerir.

“Gönderen”, Hizmetlerimiz aracılığıyla bir para transferi veya Fatura Ödemesi başlatan kişiyi ifade eder.

“Hizmetler””, bu Koşullar’ın Ek B (I.) bölümünde belirtilen finansal hizmetler anlamına gelir.

“Telefonla Para Transferi”, müşterinin belirli bir telefon numarasını arayarak, genellikle bir müşteri hizmetleri temsilcisiyle konuşarak veya otomatik bir sistem kullanarak para transferi başlattığı bir hizmettir.

“İşlem”, Gönderenden geçerli bir ödeme alındığında Gönderen tarafından Hizmetlerimiz aracılığıyla başlatılan para transferi anlamına gelir.

“İşlem Başlatma Tarihi”, Hizmetlerimiz aracılığıyla bir para transferi veya Fatura Ödemesi başlattığınız ve talebinizin işleme alınmak üzere yetkilendirildiği ve gönderildiği tarihi ifade eder.

“Web Sitesi”, Hizmetlerimizi sunmak için faaliyet gösterdiğimiz Web sitesini ifade eder.

“Siz” veya “Sizin”, Hizmetlerimizi Gönderen olarak kullanan her bir kişiyi ifade eder.

BÖLÜM B: GENEL HİZMET KOŞULLARI

I. HİZMETLERİMİZ

1. Genel. Hizmetlerimiz arasında uluslararası ve yurt içi para transferi ve Fatura Ödemesi hizmetleri (yasal olarak izin verilen ve mevcut olan durumlarda) yer alır. Her İşleme bireysel bir işlem numarası (MTCN) verilir.

2. Uygun Kullanıcılar. Hizmetleri kullanmak için (i) minimum yaş gerekliliklerini karşılamanız ve (ii) yürürlükteki kanunlar uyarınca Gönderme Ülkesinde bizimle bağlayıcı sözleşmeler yapmaya yönelik hukuki ehliyete sahip olmanız gerekir. Alıcı, Alıcı ülkesindeki minimum yaş gerekliliklerini karşılamalıdır.

3. Para Transferi. Gerekli bilgileri ve belgeleri sağladığınızda ve para transferi yapmak için bu Koşullar’ı kabul ettiğinizde, bize belirli bir İşlemi tamamlamamız talimatını verirsiniz. Her İşlem, yalnızca söz konusu para transferi için sizinle bizim aramızda ayrı bir sözleşmedir. Bu sözleşmeye dayalı olarak gelecekteki para transferlerini ele almakla yükümlü olmayız.

4. Hizmetlere Erişim. Hizmetler Konumlar, Web Sitesi, Mobil Uygulama veya Telefonla Para Transferi hizmeti aracılığıyla sağlanır. Hizmetlere bir mobil cihaz veya telefon üzerinden erişiyorsanız kablosuz servis operatörünüz veya mobil şebeke operatörünüz standart ücretler, veri ücretleri ve başka ücretler uygulayabilir.

II. ÜCRETLER VE ÖDEME

1. Transfer Ücreti. Hizmetlerimizin kullanımı karşılığında, tarafınızdan başlatılan her para transferi için o anda geçerli oran üzerinden bir ücreti (“Transfer Ücreti”) ve uygulanan tüm vergileri bize ödemeyi kabul edersiniz. İşleminiz için geçerli Transfer Ücreti, İşleminiz için nihai onayınızdan önce, ek hizmetlere yönelik tüm ücretlere ve geçerli vergilere ek olarak size sunulacaktır. Bazı durumlarda, para transferinin Alıcısına yapılan ödeme yerel vergilere ve hizmet ücretlerine tabi olabilir.

2. Yabancı Para Birimi. TRANSFER ÜCRETİNE EK OLARAK, PARA BİRİMİNİZİ YABANCI PARA BİRİMİNE DÖNÜŞTÜRDÜĞÜMÜZDE DE KAZANÇ ELDE EDERİZ. Uluslararası para transferleri genellikle varış ülkesi tarafından izin verilen para birimi veya para birimleriyle ödenir. Bir İşlem para biriminizin farklı bir para birimine dönüştürülmesini gerektiriyorsa dönüştürme işlemi, transfer için son onayınızı vermeden önce gösterildiği veya paylaşıldığı gibi geçerli döviz kuru üzerinden uygulanır. Para birimi transfer sırasında dönüştürülür ve Alıcı gösterilen yabancı para birimi tutarını alır. Tüketici döviz kurları, kullandığımız toptan döviz piyasasındaki bankalar arası kurlara bir kâr marjı eklenerek belirlenir. Döviz kurları, küresel finansal piyasalara göre günde pek çok kez değişir. Bizim aldığımız döviz kuru ile sizin aldığınız döviz kuru arasındaki fark bizde kalır. Geçerli Transfer ücreti ve döviz kuru, seçilen ödeme para birimine göre değişiklik gösterebilir. Geçerli döviz kurları için lütfen Web sitemizi ziyaret edin veya aşağıdaki iletişim bilgilerini kullanarak bizimle iletişime geçin.

Bazı ülkelerin yerel yasaları, Alıcıya ödeme sırasında para biriminin dönüştürülmesini gerektirir. Böyle bir durumda, döviz kuru ve size gösterilen veya sizinle paylaşılan tutarlar, transferi yaptığınız zaman ile Alıcının parayı aldığı zaman arasındaki döviz kuru dalgalanmalarına tabi olabilir.

Bazı ülkeler, Alıcılara birden fazla para biriminde ödeme yapılmasına izin verir. Böyle bir durumda, İşleminiz sırasında ödeme para birimini seçmeniz gerekir. Bazı ülkeler, bir Alıcının sizin seçtiğinizden farklı bir para biriminde ödeme almasına izin verir. Bu gibi durumlarda bu ayrı bir işlem olarak kabul edilebilir ve paranız Alıcı tarafından seçilen para birimine dönüştürüldüğünde ek kazanç sağlayabiliriz.

3. SMS Bildirimleri ve Ücretleri. SMS (Kısa Mesaj Servisi) bildirimi, sizi ve/veya Alıcınızı İşleminiz hakkında önemli bilgiler konusunda bilgilendirmek için kullanılabilir. Bir mobil şebeke operatörü tarafından uygulanan ücretler Gönderenin veya Alıcının münhasır sorumluluğudur. SMS mesajlarıyla ilgili hiçbir ücretten biz sorumlu tutulamayız. Geçerli kanunlara tabi olarak SMS, İşlem sırasında Gönderenin ve/veya Alıcının cep telefonu numarasına gönderilir.

4. Hesap Kullanma. Banka hesabı, Banka Kartı, dijital cüzdan, fatura eden veya başka bir hesap türü gibi bir hesaptan (“Hesap”) para gönderebilir veya bu tür bir hesaba para alabilirsiniz. Hesap, sizden ekstra ücret talep edebilecek bir banka veya başka bir sağlayıcı (“Hesap Sağlayıcısı”) tarafından sağlanır. Bir Hesap kullandığınızda Hesap Sağlayıcısı ile yapılan sözleşmeye uymanız gerekir. Hesap Sağlayıcısının neden olduğu herhangi bir ücret veya sorundan biz sorumlu olmayız. Hesabınızdan farklı bir para biriminde para göndermeniz veya almanız durumunda Hesap Sağlayıcısı para birimini kendi kurundan çevirebilir veya transferi reddedebilir. İş amaçlı kullanılan hesaplardan değil, yalnızca kişisel amaçlar için kullanılan Hesaplardan ödeme kabul eder ve bu tür Hesaplara para göndeririz. İşlem talimatlarını sağlayarak İlişkili hesapların yalnızca kişisel kullanım için olduğunu onaylarsınız. Bir Hesaba veya Hesaptan yapılan transferleri işlemek için farklı yöntemler kullanabiliriz. Bize yanlış hesap numarası veya Hesap bilgileri vermeniz durumunda parayı bize verdiğiniz hesap numarasına aktarırız. Hesap Sağlayıcısı veya sizin tarafınızdan yapılan hatalardan biz sorumlu olmayız. Bir Hesap kullanmak için sizden ekstra ücret alabiliriz; bir transfer yapmadan önce size ücretleri söyleriz.

Bir Hesaptan İşlem başlatarak (i) Hesabın sahibi olduğunuzu ve İşlemi başlatma yetkiniz olduğunu doğrular ve (ii) hesabınıza elektronik borç ve/veya kredi yansıtmamız ya da bir İşlemin tamamlanamaması halinde hataları işlememiz ve düzeltmemiz için bize yetki verirsiniz.

(1) Hesabınızda yeterli para olmadığında; (2) Hesabınız kapalıysa veya hesabınızdan para çekme kısıtlıysa; (3) işlem Western Union veya Hesap Sağlayıcınız tarafından belirlenmiş olan dolar ya da sıklık sınırlamalarını aştığında; (4) Kontrolümüz dışındaki durumlarda (sel, yangın, elektrik kesintisi, mekanik arızalar veya sistem arızaları gibi); (5) Hesap Sağlayıcınız bir işlemi yerine getirmediğinde, işlem gerçekleştirilmediğinde veya Hesap Sağlayıcınız tarafından geri döndürüldüğünde; (6) talimatlarınız bize iletilirken kaybolduğunda veya geciktiğinde; (7) makul bir güvenlik endişesi ya da Hizmet seçeneğinin kullanımdan kaldırılması veya askıya alınması nedeniyle işleminizi gerçekleştiremediğmizde ya da başka şekilde Sizi isteğinizin gerçekleştirilmeyeceği konusunda bilgilendirdiğimizde ve (8) yasanın izin verdiği diğer istisnai durumlarda size karşı sorumlu olmayız.

5. Ödeme Seçenekleri. Hizmetlerimiz aracılığıyla başlattığınız her İşlem için Transfer ücretini ve diğer geçerli ücretleri bize ödeyeceğinizi kabul edersiniz. Ödeme seçenekleri, Gönderme Ülkenize bağlı olarak değişir. Gönderme Ülkesinde yetkilendirilmiş bir Banka Kartı kullanarak veya diğer geçerli ödeme yöntemleri aracılığıyla Hizmetler için ödeme yapabilirsiniz. Ayrıca Konumda nakit ödeme yapabilir veya mevcut diğer ödeme seçeneklerini kullanabilirsiniz. Toplam tutar, İşlemi gerçekleştirmemizden önce ödenir. Banka Kartı ile ödeme yapmanız ve Banka Kartını Düzenleyenden (veya Otomatik Takas Merkezi (“ACH”) veya ödeme kimliği ile kullanılabilir bakiye durumunda Hesap Sağlayıcınızdan) yetki almamanız durumunda İşlem gerçekleştirilmez ve para Alıcıya iletilmez. Hizmetler için ödeme yapmak üzere Banka kartınızı veya ACH’yi her kullandığınızda, toplam tutar (ana tutar, Transfer Ücreti, döviz kurları ile ilgili ücretler ve diğer geçerli ücretler veya vergiler dahil) için belirlenmiş Banka Kartınızdan veya geçerli Hesabınızdan tahsilat yapma yetkimiz olduğunu kabul edersiniz.

III. İŞLEM ÖDEMELERİ

1. Ödeme Yöntemleri. Bir konumda nakit para, varsa banka kartı, banka hesabı veya dijital cüzdana doğrudan para alma dahil ancak bunlarla sınırlı olmamak üzere Alıcının parayı alması için çeşitli yöntemler sunarız. Bazı ülkelerde Alıcı, Gönderen tarafından seçilen yöntemden farklı olan bir para alma yöntemi seçme veya ödeme para birimini değiştirme seçeneğine sahip olabilir. Gönderen, Gönderenin talimatlarından farklı olsa bile Alıcının para alma yöntemi veya ödeme para birimi seçimini kabul etmemize izin verir. Tüm ödeme yöntemleri Alıcının Ülkesi ve Konumundaki uygunluk durumuna bağlıdır.

2. Alıcınızı Tanımlama. Bir kişinin bir Konumda nakit teslim alma sırasında, sizin istediğiniz Alıcı olduğunu belirlemek için Alıcınız tam adını, kimlik belgesini, sizin adınızı, MTCN’yi ve yaklaşık transfer tutarını sağlamaya hazır olmalıdır. Bazı ülkelerde bir test sorusu eklemeyi tercih edebilirsiniz. Bu durumda, sorunun yanıtını Alıcınızla paylaşın. Ayrıca, Alıcının başka bilgiler sağlamasını da talep edebiliriz. İşlem, Alıcının sağladığı bilgilere ve belgelere göre alma hakkına sahip olduğunu takdir ettiğimiz kişiye ödenir. Alıcının adres bilgilerini doğrulamayız. Sağladığınız ad ve Alıcınızın kimlik belgesindeki ad küçük farklılıklar gösterse bile Alıcının ödemesini yapabiliriz (ancak ad farklıysa ödeme yapma yükümlülüğümüz bulunmamaktadır). Sağlanan bilgilerin yeterli olmadığına kanaat getirmemiz halinde ödemeyi reddederiz ve para transferi size iade edilmeye hazır hale gelir. Bir banka hesabına veya dijital cüzdana gönderilen işlemlerde parayı sizin tarafınızdan belirlenen hesaba aktarırız. Hesap numarasının sahibi (cep telefonu numaraları veya Alıcının hesabını tanımlamak için tarafınızdan sağlanan diğer bilgiler dahil) ile amaçlanan Alıcının adı arasında tutarsızlık olması durumunda transfer, tarafınızdan sağlanan hesap numarasına aktarılır. Bunlara dayalı olarak işlem yaptığımızdan lütfen sağladığınız numaraların doğruluğunu kontrol edin.

IV. KISITLAMALAR

1. Kullanılabilirlik. Hizmetlerin kullanılabilirliği ülkeye ve yargı bölgesine göre değişiklik gösterebilir ve değişebilir. Hizmetin kullanılabilirliği; seçilen belirli Hizmet, gecikmeli teslim seçimi, her bir Hizmet için geçerli olan özel şartlar, gönderilen tutar, varış noktası olan ülke, para birimi kullanılabilirliği, yasal veya tüketiciyi korumayla ilgili konular, kimlik gereksinimleri, teslimat kısıtlamaları, Konumun çalışma saatleri ve saat dilimlerindeki farklar dahil olmak üzere belirli etkenlere bağlıdır.

2.Yasaklı Kişiler veya İşlemler. Yasal gerekliliklere uygun olarak, belirli kişilerle veya belirli ülkelerde iş yapmamız yasaktır ve Amerika Birleşik Devletleri, Avrupa Birliği ve Birleşik Krallık dahil olmak üzere çeşitli devlet kurumları tarafından uygulanan yaptırımlara tabi olarak belirlenmiş kişiler listesine göre İşlemleri tararız. Siz veya Alıcınız listeyle eşleşiyor gibi görünüyorsa sizin veya Alıcınızın kimliğinin yaptırımlara tabi olarak belirlenmiş kişi ile aynı olmadığını doğrulamak üzere sizden ek bilgi talep ederiz. Bu, doğum yeri ve tarihi ile kimlik belgelerini içerebilir. Eşleşme olup olmadığını belirlemek İşlemi geciktirir. Kanunlara uygun olarak paranızı dondurmamız gerekebilir.

3. İzin Verilen Kullanım. Bu Koşullar’ı veya politikalarımızı (dolandırıcılığı, suç gelirlerinin aklanmasını veya terörizmin finansmanını önleme amaçlı politikalar dahil) ihlal eden herhangi bir İşlem gerçekleştirirseniz veya gerçekleştirmeye çalışırsanız ya da dolandırıcılık niyetiyle hareket eder veya kasıtlı olarak veya büyük ölçüde ihmalkar bir davranış yoluyla İşlem verilerinin kötüye kullanılmasına katkıda bulunursanız Hizmetlerimizi size kısmen veya tamamen sağlamayı reddedebiliriz ve bu Koşullar’da bulunan haklarımızdan herhangi birini kullanmaya hak kazanırız ve/veya İşlemi ilgili emniyet teşkilatına bildiririz ve/veya herhangi bir yetkisiz İşlem için sizden kaynaklanan tüm kayıp ve zararlar için sizden tazminat talep ederiz. Özellikle, Hizmetlerimizi aşağıdakiler dahil ancak bunlarla sınırlı olmamak üzere herhangi bir yasayı ihlal etmek için kullanmayın: (i) terörizmi finanse etmek, (ii) suç gelirlerini aklamak, (iii) telefon pazarlamacılarına ödeme yapmak (yalnızca ABD), (iii) tütün ürünleri satın almak veya (iv) dolandırıcılık, hırsızlık veya yasa dışı kumar dahil olmak üzere her türlü suça destek olmak. Emanet hizmeti sağlamamaktayız. Emanet fonlarını ödemek için Hizmetleri kullanmayın. Yukarıdaki nedenlerden herhangi biriyle Hizmetlerimizi size (kısmen veya tamamen) sunmayı reddetmemiz durumunda, mümkünse size bildirimde bulunuruz ve yasal nedenlerle veya güvenlik nedenleriyle bunu yapmamıza bir engel olmadığı sürece reddetme nedenimizi size iletiriz. Hizmetlerimizi kullanarak, sizin ve Alıcınızın kullanımının yasal olduğunu, buna izin verildiğini ve bunun bu koşulları ihlal etmediğini onaylarsınız.

V. GİZLİLİK

Gizliliğinizi korumak bizim için çok önemlidir. Gizliliğinizi koruma taahhüdümüzün yanı sıra bilgilerinizi ne şekilde kullanıp ifşa ettiğimizi daha iyi anlamak için lütfen Western Union’ın Küresel Gizlilik Bildirimi‘ni inceleyin.

VI. SORUMLULUĞUN SINIRLANDIRILMASI

BU TÜR BİR KOŞUL VEYA GARANTİNİN İHLALİNE İLİŞKİN SORUMLULUĞUMUZ, YEREL YASALARCA YASAKLANAN DURUMLAR HARİÇ OLMAK KAYDIYLA, ETKİLENEN HİZMETİN TEKRAR SAĞLANMASININ MALİYETİ İLE VEYA 500 ABD DOLARINA EŞDEĞER TUTAR İLE (HANGİSİ DAHA FAZLA İSE) SINIRLI OLACAKTIR.

AVUKATLIK ÜCRETLERİ VE BİR ANLAŞMAZLIK İÇİN GÖRÜŞME DAHİL OLMAK ÜZERE, yerel yasalarınız çerçevesinde ek haklara sahip olabilir ve bu haklardan yararlanmak isteyebilirsiniz.

PARA TRANSFERİ HİZMETLERİMİZ YOLUYLA ÖDENEN HERHANGİ BİR ÜRÜN VEYA HİZMETİN TESLİMİNİ VEYA UYGUNLUĞUNU GARANTİ ETMEYİZ.

VII. ŞİKAYETLER, GEÇERLİ KANUN, ANLAŞMAZLIKLAR

1. Hukuk Seçimi ve Anlaşmazlıkların Çözümü. Bu Koşullar ve tüm İşlemler, Gönderme Ülkesinin yasalarına tabidir. Bu Koşullar kapsamındaki veya herhangi bir İşlemle ilgili her türlü anlaşmazlık, söz konusu meseleyi bağımsız bir kuruluşa veya ombudsman’a yönlendirmek de dahil olmak üzere, Gönderen tarafından söz konusu ülkenin mahkemelerine veya diğer bilinen anlaşmazlık çözüm forumlarına taşınabilir. VIII. TAZMİNAT

IX. İPTAL VE İADELER

İlgili kanunlara tabi olarak, yazılı talebinizi aldığımız sırada paranın alınmış veya yatırılmış olduğu durumlar hariç olmak kaydıyla, bir İşlemi geri ödeme için iptal edebilirsiniz. Orijinal İşlem başlatma tarihinden itibaren 30 gün içinde alınan geri ödeme talepleri, hem transfer tutarının hem de ödenen ücretlerin iadesi için uygun olacaktır. Orijinal İşlem başlatma tarihinden 30 gün sonra talep edilen geri ödemeler, yalnızca transfer tutarının iadesi için uygun olacaktır. Vergi aldığımız durumlarda, yasalar veya yerel uygulamalar tarafından aksi zorunlu kılınmadıkça, vergiler iade edilir.

X. MÜŞTERİ HİZMETLERİ

Hizmetlerimizde hata tespit ederseniz veya sorunlarla karşılaşırsanız ya da Hizmetlerimizden memnun değilseniz lütfen Müşteri Hizmetleri sayfamızı ziyaret edin. Temsilcimiz şikayetlerinizi adil ve hızlı bir şekilde araştıracaktır.

XI. DİĞER BİLGİLER

1. Devir. Geçerli yasaya tabi olarak, Sizin izniniz olmadan bu Koşullar’ı bir üçüncü tarafa devredebiliriz.

2. Sözleşmenin Bütünlüğü. Bu Koşullar, sizinle aramızdaki sözleşmenin tamamını oluşturur ve sizinle aramızda mevcut olabilecek önceki tüm anlaşmaların yerini alır.

3. Dil. Bu Koşullar size kolaylık sağlamak için birden fazla dilde sağlanabilir. Herhangi bir farklılık olması halinde, geçerli kanunların izin verdiği şekilde, İngilizce versiyon geçerli olacaktır.

4. Feragat Yasağı. Bu Koşullar, hükümlerden biri veya daha fazlası geçersiz, yasa dışı veya uygulanamaz olsa bile geçerlidir. Diğer hükümlerin geçerliliği etkilenmez.

5. Mücbir Sebep. Geçerli kanunlardaki değişiklikler; gerekli fiziksel ve ağ altyapısının kapatılması veya kullanılamaması; ülkenin temerrüde düşmesi; elektrik veya internet arızası, sivil ayaklanma, savaş ve deprem, yangın, sel veya diğer doğal afetler dahil olmak üzere makul kontrolümüz dışındaki olaylardan kaynaklanan bir hata veya gecikme olması durumunda Hizmetlerin yerine getirilmesindeki bir hata ya da gecikmeden sorumlu olmayız.

6. Bölünebilirlik. Bu Koşullar’ın herhangi bir kısmının yetkili yargı yetkisine sahip bir mahkeme tarafından geçersiz, yasa dışı veya uygulanamaz olduğu tespit edilirse bu kısım çıkarılacak ve Koşullar’ın geri kalan kısmı, yasaların izin verdiği en geniş ölçüde geçerli ve uygulanabilir olmaya devam edecektir.

7. Diğer Koşullar. Bu Koşullar, diğer ürün ve hizmetlerimizi kullanmanıza bağlı olarak sizin için geçerli olan promosyonlar, yönlendirme programı ve diğer koşullarla tamamlanabilir. Bu koşullardan herhangi birinin bu Koşullar ile çelişkili olduğu belirlendiği ölçüde, bu Koşullar geçerli olacaktır.

6. Purpose of the transaction. In carrying out the transaction, the client declares to be fully aware of the text contained in the respective receipt, Articles 3 and 4 of Law No. 14,286 of December 29, 2021, and in particular the second and third paragraphs of Article 4, transcribed in this document, as well as BCB Resolution No. 277, of December 31, 2022, which govern this operation. 7. Fraud. Customer declares to be aware that Western Union will process, store, share and record your personal data and information for fraud control and prevention purposes, with the aim of ensuring the security of operations. According to current regulations, personal data and information may be shared with companies in your conglomerate, third-party companies, other institutions belonging to the National Financial System, payment institutions and regulatory bodies.

WU WARNS THAT SENDING MONEY TO A PERSON THE SENDER DOES NOT KNOW SHOULD NOT BE CARRIED OUT. INFORMATION AND DETAILS OF MONEY TRANSFERS SHOULD BE SHARED ONLY WITH THE BENEFICIARY.

V. PRIVACY

Your personal data (“Personal Data”) is processed and controlled by Western Union in accordance with the provisions of Federal Law No. 13,709/2018. Western Union collects and uses the personal data provided when sending the transfer of funds, along with other information collected or generated during your relationship with Western Union, in order to provide the contracted services appropriately and in complete manner.

To execute the transaction, Western Union will retain and retain the personal data that the sender provides about the recipient of the transfer of funds (“Third Party Personal Data”). Without the respective personal data and the personal data of third parties, it is not possible to perform the money transfer service. To perform international money transfer transactions through the Mobile Application, using online bank transfers, the customer must enter his personal data in the Mobile Application and without leaving this environment will be redirected to a bank gateway through which he must authorize from his exclusively personal account the corresponding debit. 3. Money Transfer.
To make a money transfer, You may be required to provide Us with the following information, to the extent applicable or required:
(i) The name of the Sender;
(ii) The name of the Receiver;
(iii) The amount and currency under which the Transaction is to be conducted;
(iv) The payment account details of the relevant Receiver, if applicable;
(v) The date of the Transaction order; and
(vi) Any other information as may be required by Us to execute the Transaction.

6. Verification.
We may be required to carry out customer due diligence on You as part of Our know your customer (KYC) policy. We may request for information and documentation prior to or during your use of the Services, including information or documentation relating to Your identity. You agree that Your use of the Services may be subject to Our KYC and verification process.
You agree that We are entitled to check and verify the information You provide, either directly or indirectly through any third party, including through databases. If You fail or refuse to provide the information requested by Us under this section, or if the information You have provided Us with is found to be untrue, inaccurate, or incomplete, We shall be entitled to deny and block Your use of the Services.

7. Execution of Transaction. Notwithstanding any other provision, We may refuse to execute a Transaction if the information provided by You is untrue, inaccurate, or incomplete. In the event of Our refusal to execute the Transaction, We shall inform You regarding the details of such refusal, within 7 seven working days after We have received Your Transaction order.

4. Foreign Exchange Limitation.
Foreign currency transactions, if any, including the purchase or sale of Indonesian Rupiah for foreign currencies, or vice versa, may be subject to certain limitations as determined by Bank Indonesia. If Your Transaction exceeds applicable limits, You may be required to provide additional documents, including but not limited to documentation relating to the relevant Transaction and any other supporting document We may request for. You acknowledge that We are entitled to not execute the Transaction if You do not present sufficient documentation or information.

The following provision amends Part B, Section VII, Subsection 1:
1. Governing Law and Dispute Resolution.
These Terms and any Transaction are governed by the laws of the Send Country. If the Sender is located in Indonesia, any dispute arising out of or in connection with these Terms or any Transaction may be brought before the District Court of Central Jakarta, which shall serve as the primary forum for dispute resolution. Notwithstanding the above, if permitted under applicable law and mutually agreed upon, We may opt to resolve disputes through arbitration, in a forum of the parties’ choosing. In the event of any conflict between these Terms and applicable law, the provisions of the applicable law shall prevail.

8. Amendments.
We may update, amend, or revise these Terms from time to time. If any material changes are made, We will notify you by email or through other appropriate means. By continuing to use Our Services after such amendments take effect, You agree to be bound by the amended Terms. If You do not agree with the amendments, You may stop using our Services. In any event, upon the lapse of 30 working days from Our notification to You regarding the amendments to these Terms, You shall be deemed to have agreed to the amendments made to these Terms.

Western Union Japan KK is licensed by the Kanto Local Finance Bureau (registration number: 00039), to offer Type II fund transfer services business in Japan and conducts fund transfer transactions of 1,000,000 yen or less.

The Transaction is not conducted by a bank. Transactions do not involve the acceptance of deposits or term deposits, savings or installment savings. Transactions are not the subject of insurance payment prescribed by Article 53 of the Deposit Insurance Act (Act No. 34 of 1971) or Article 55 of the Agricultural and Fishery Cooperation Savings Insurance Act (Act No.53 of 1973). Western Union has signed and executed a Guarantee Agreement with Mizuho Bank, Ltd. to ensure that all users in Japan are protected by the Performance Protection Funds contained in Article 44 of the Money Transfer Business Act. You have the right to claim onto performance security funds defined in Article 59 of the Money Transfer Business Law (Act No.59 of 2010).

Currently, bank transfer and payment through certified collection partners is the applicable Payment Method. Therefore, the terms “Bank Card” and “Card Issuer” are provided for illustrative purposes only.

IV: RESTRICTIONS

Not Available for certain Individuals or Transactions: (1) “You acknowledge and confirm that in line with applicable law, funds sent or received shall not, directly or indirectly be to/ from North Korea or Iran (or such other countries as may be prohibited from time to time in accordance with applicable law) (2) You must not be a member of a bouryoku-dan or organized crime group (“Antisocial Force”) or have association with an Antisocial Force, or, if You are a corporation, any of Your respective directors, officers or employees must not be a member of an Antisocial Force or have association with an Antisocial Force. In the event that We come to know or have a reason to believe that You are a member of an Antisocial Force or has association with an Antisocial Force, or, if You are a corporation, that any of Your respective directors, officers or employees is a member of an Antisocial Force or has association with an Antisocial Force, We will immediately take all the necessary steps to prevent any further use of the Western Union Online Service by You. Prompting these steps does not make Us liable for any loss or damage that are the result of Your failure to comply with Your responsibility in accordance with the preceding paragraph.

VII. COMPLAINTS, APPLICABLE LAW, DISPUTES

We will promptly investigate any claims arising out or relating to the Transaction. If You are not satisfied with such investigation, You may refer the claim and dispute to the Japan Money Senders Association (“JMSA”) at 03-3556-6261, 7/F, 3-8-11 Kudan-minami, Chiyoda-ku, Tokyo 102-0074, or Tokyo Bar Association Dispute Center for Conflict Resolution at 03-3581-0031, or Daiichi Tokyo Bar Association Dispute for Arbitration Center at 03-3581-8588, or Daini Tokyo Bar Association Dispute for Arbitration Center at 03-3581-2249, to resolve or follow the JMSA guidelines to resolve the dispute by arbitration.to resolve or to resolve the dispute by arbitration.

8. Safeguarding rules.
The required security deposit amount is determined on every Saturday at 24:00 midnight New York time (every Sunday at 1:00pm Tokyo time) as the maximum of the required security deposit amounts during the 7-day period of the previous week from Sunday 0:00 midnight New York time to Saturday 24:00 midnight New York time. The required deposit amount will be added to the Guarantee Agreement with Mizuho Bank as described in clause 15.4 above. In case the Guarantee Agreement would not work for whatever reason, the required deposit will be deposited with an official depositary within 3 (three) business days (excluding Sundays, Saturdays, holidays prescribed in the Act on National Holidays, January 2nd, January 3rd, and from December 29th to December 31st) from the end of the 7-day period so specified in the preceding sentence.

9. No Retention by Us. We shall not hold funds received from You which are not used for transactions. With respect to funds received from You via a Payment Method which are deemed not to be used for transactions, We shall return such funds to You or take other measures not to retain such funds. We will only conduct fund transfer transactions of 1,000,000 yen or less.

WUPSA will maintain and retain Personal Data that the sender provides to us about the recipient of the money transfer to execute the transaction (“Third Party Personal Data”). Without the respective Personal Data and Third Party Personal Data, it is not possible to carry out the money transfer service. Western Union Global Network Pte Ltd has arranged for the aggregate relevant money of its customers to be safeguarded in a combination of two ways: (a) a certain amount (the “Guaranteed Amount”) is safeguarded by a guarantee given by a safeguarding institution that is a licensed bank in Singapore, which requires the safeguarding institution to pay the Guaranteed Amount in the event of the insolvency of Western Union Global NetworkPte Ltd, in accordance with the applicable requirements of the PSA; and (b) an amount equivalent to all remaining relevant money which exceeds the Guaranteed Amount will be held by Western Union Global Network Pte Ltd on behalf of its customers in a trust account (the “Trust Account”) opened with another safeguarding institution that is also a licensed bank in Singapore. Generally, any relevant money received from a customer of Western Union Global Network that is deposited in the Trust Account will be commingled with relevant money received from other customers of Western Union Global Network Pte Ltd. Consequently, you acknowledge that it is not possible to identify any portion of the relevant money in the Trust Account as specifically belonging to you (nor is it possible to identify whether your relevant money is covered under the Guarantee as opposed to being deposited in the Trust Account) and money in the Trust Account could be withdrawn to meet the obligations of other customers. If the safeguarding institution with which the Trust Account is maintained becomes insolvent, you may be delayed or prevented from recovering your full entitlement to the relevant money.
 
The following provision supplements Part B, Section VI:
We assume liability for the execution of a money transfer order in the event of the fault of an employee or vicarious agent acting on Our behalf, pursuant to the provisions set forth under Singapore law. The liability of Western Union, Western Union affiliates and foreign agents is excluded for cases of negligence. This exclusion does not apply in the case of death, bodily injury or impairment of health, nor in the case of violating major contractual obligations. In the case of violating ancillary contractual obligations through negligence Our liability is limited to replacing the typical and reasonably foreseeable damage up to the maximum amount of SGD 500 (in addition to the transferred amount and the fees charged).
 
The following provision amends Part B, Section VI, Subsection 1:
1. Choice of Law and Dispute Resolution.
These Terms shall be governed and construed in accordance with the laws of the Republic of Singapore and the parties submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
