WESTERN UNION® NAUDAS PĀRSKAITĪJUMU PAKALPOJUMA NOTEIKUMI UN NOSACĪJUMI

Jūs noslēdzat līgumu saskaņā ar šiem Naudas pārskaitījumu Noteikumiem un nosacījumiem (turpmāk tekstā — “Noteikumi”) ar Western Union licencētu meitasuzņēmumu (katrs atsevišķi “Western Union uzņēmums”, un kopā “Western Union uzņēmumi”) vai licencētu partneri, pārstāvi vai aģentu ( “Partneris”) (“mēs“, “mūsu” vai “mums” attiecas uz attiecīgo Western Union uzņēmumu un/vai partneri), kas piedāvā Pakalpojumus saskaņā ar savu licenci, sadarbojoties ar Western Union uzņēmumu mūsu pakalpojumu sniegšanai valstī, no kuras jūs veicat darījumu “Nosūtītāja valsts”). Jūs sadarbojaties ar Western Union uzņēmumu/uzņēmumiem vai partneri, kuram pieteicāties mūsu pakalpojumu saņemšanai. Viņu informāciju var atrast A pielikumā – Valstīm specifiski noteikumi vai jūsu čekā. Jebkuri atšķirīgi vai papildu noteikumi, kas var attiekties uz jums atkarībā no Nosūtītāja valsts, ja tādi ir, ir atrodami A pielikumā – Valstīm specifiski noteikumi. Mēs piedāvājam arī papildu finanšu pakalpojumus, kas nav ietverti šajos Noteikumos (piemēram, digitālā maka pakalpojumus). Lai izmantotu šos papildu finanšu pakalpojumus, jums, iespējams, būs jāpiekrīt arī papildu noteikumiem un nosacījumiem, kas attiecas uz konkrēto pakalpojumu.

A DAĻA: IEVADS

Šie Noteikumi attiecas uz mūsu pakalpojumiem, kā definēts tālāk. Izmantojot mūsu pakalpojumus, jūs apstiprināt, ka piekrītat šiem Noteikumiem un piekrītat tos ievērot. Ja jūs nepiekrītat šiem Noteikumiem, jūs nedrīkstat izmantot mūsu Pakalpojumus. Mēs jums iesakām izdrukāt vai saglabāt šo Noteikumu kopiju turpmākām uzziņām.

Mēs jebkurā laikā un bez saistībām varam mainīt vai pārtraukt visus Pakalpojumus vai to daļu (tostarp piekļuvi, izmantojot trešo pušu saites); iekasēt, mainīt vai atcelt noteiktas ar Pakalpojumiem saistītas maksas; vai piedāvāt Pakalpojumus vai atsevišķus Pakalpojumus dažiem vai visiem lietotājiem.

I. DEFINĒTIE TERMINI

Turpmāk minētajiem terminiem ir tālāk izklāstītā nozīme. Visi papildu definētie termini tiks norādīti iekavās attiecīgajā sadaļā. Šajos Noteikumos pasvītrotie vārdi satur hipersaites uz papildu informāciju.

“Bankas karte” attiecas vai nu uz debetkarti, vai priekšapmaksas karti un, attiecīgā gadījumā, uz kredītkarti (piemēram, Visa vai Mastercard).

“Rēķinu apmaksa” attiecas uz pakalpojumu, kas pieejams dažās valstīs un ļauj klientiem plānot, pārvaldīt un veikt maksājumus dažādiem rēķinu izrakstītājiem.

“Kartes izsniedzējs” attiecas uz bankas kartes izsniedzēju un īpašnieku.

“Atrašanās vieta” attiecas uz vietām, kur jūs varat pārskaitīt un saņemt naudu vai dažās valstīs apmaksāt rēķinu klātienē pie mums. Tās ietver dažādas vietas, piemēram, bankas, lielveikalus, finanšu iestādes, pasta nodaļas, kioskus un citus mazumtirgotājus.

“Mobilā lietotne” attiecas uz mobilo lietotni, ko mēs esam padarījuši pieejamu patērētājiem Pakalpojumu izmantošanai.

“Saņēmējs” attiecas uz saņēmēju, kuru sūtītājs ir norādījis līdzekļu saņemšanai, un ietver rēķinu apmaksas pakalpojumā iekļautos rēķinu izrakstītājus.

“Nosūtītājs” attiecas uz personu, kura, izmantojot mūsu pakalpojumus, uzsāka naudas pārskaitījumu vai rēķinu apmaksu.

“Pakalpojumi” nozīmē finanšu pakalpojumus, kas noteikti šo Noteikumu B daļas (I) punktā.

“Naudas pārskaitījums pa tālruni” attiecas uz pakalpojumu, kurā patērētājs uzsāk naudas pārskaitījumu, zvanot uz norādīto tālruņa numuru, parasti runājot ar klientu apkalpošanas pārstāvi vai izmantojot automatizētu sistēmu.

“Darījums” attiecas uz naudas pārskaitījumu, ko uzsāk sūtītājs, izmantojot mūsu pakalpojumus, pēc derīga maksājuma saņemšanas no sūtītāja.

“Darījuma uzsākšanas datums” attiecas uz datumu, kad jūs veicat naudas pārskaitījumu vai rēķina apmaksu, izmantojot mūsu pakalpojumus, un jūsu pieprasījums ir autorizēts un iesniegts apstrādei.

“Tīmekļvietne” attiecas uz tīmekļvietni, kuru mēs pārvaldām, lai nodrošinātu mūsu pakalpojumus.

“Jūs” vai “Jūsu” attiecas uz ikvienu personu, kas izmanto mūsu pakalpojumus kā sūtītājs.

B DAĻA: VISPĀRĪGI PAKALPOJUMU NOTEIKUMI

I. MŪSU PAKALPOJUMI

1. Vispārīgi. Mūsu pakalpojumi ietver starptautiskus un iekšzemes naudas pārskaitījumus un Rēķinu apmaksas pakalpojumus (ja tas ir juridiski atļauts un pieejams). Katram darījumam tiek piešķirts individuāls darījuma numurs — MTCN.

2. Atbilstīgie lietotāji. Lai izmantotu pakalpojumus, jums ir (i) jāatbilst minimālā vecuma prasībām un (ii) jābūt tiesībspējai un rīcībspējai noslēgt ar mums saistošus līgumus Nosūtītāja valstī saskaņā ar piemērojamajiem tiesību aktiem. Saņēmējam ir jāatbilst minimālā vecuma prasībām Saņēmēja valstī.

3. Naudas pārskaitījums. Kad jūs sniedzat nepieciešamo informāciju un dokumentāciju un piekrītat šiem Noteikumiem, lai veiktu naudas pārskaitījumu, jūs dodat mums norādījumus izpildīt konkrētu Darījumu. Katrs Darījums ir atsevišķs līgums starp jums un mums, tikai attiecībā uz šo naudas pārskaitījumu. Mums nav pienākuma apstrādāt nekādus turpmākus naudas pārskaitījumus, pamatojoties uz šo līgumu.

4. Piekļuve pakalpojumiem. Pakalpojumi tiek sniegti, izmantojot Atrašanās vietas, Tīmekļvietni, Mobilo lietotni vai Naudas pārskaitījuma pa tālruni pakalpojumu. Ja jūs piekļūstat Pakalpojumiem, izmantojot mobilo ierīci vai tālruni, jūsu bezvadu pakalpojumu sniedzējs vai mobilo sakaru operators var piemērot standarta maksas, datu pārraides likmes un citas maksas.

II. MAKSAS UN MAKSĀJUMS

1. Pārskaitījuma maksa. Apmaiņā pret mūsu pakalpojumu izmantošanu jūs piekrītat maksāt mums maksu par katru jūsu uzsāktu naudas pārskaitījumu saskaņā ar spēkā esošo likmi (“Pārskaitījuma maksa”), kā arī visus piemērojamos nodokļus. Pirms jūsu galīgās darījuma autorizācijas jums tiks paziņota piemērojamā pārskaitījuma maksa par jūsu Darījumu, kā arī jebkādas maksas par papildu pakalpojumiem un piemērojamie nodokļi. Dažos gadījumos naudas pārskaitījuma saņēmējam veiktā maksājuma veikšanai var tikt piemēroti vietējie nodokļi un pakalpojumu maksas.

2. Ārvalstu valūtas maiņa. PAPILDUS TRANSAKCIJAS MAKSAI MĒS PELNĀM, MAINOT JŪSU VALŪTU UZ ĀRVALSTU VALŪTU. Starptautiskie naudas pārskaitījumi parasti tiek veikti galamērķa valsts atļautajā valūtā vai valūtās. Ja Darījuma veikšanai ir nepieciešams konvertēt jūsu valūtu citā valūtā, konvertācija tiks veikta pēc piemērojamā pašreizējā valūtas maiņas kursa, kas norādīts vai paziņots jums pirms jūsu galīgās pārskaitījuma autorizācijas. Valūta tiks konvertēta pārskaitījuma brīdī, un Saņēmējs saņems norādīto ārvalstu valūtas summu. Patērētāju valūtas kursi tiek noteikti, pievienojot starpību starpbanku kursiem, kas mums ir pieejami vairumtirdzniecības tirgū. Valūtas kursi mainās vairākas reizes dienā, pamatojoties uz globālajiem finanšu tirgiem. Mēs paturam jebkādu starpību starp mūsu saņemto valūtas kursu un jūsu saņemto valūtas kursu. Piemērojamā Pārskaitījuma maksa un valūtas maiņas kurss var atšķirties atkarībā no izvēlētās maksājuma valūtas. Lai uzzinātu aktuālos valūtas maiņas kursus, lūdzu, apmeklējiet mūsu tīmekļvietni vai sazinieties ar mums, izmantojot tālāk norādīto kontaktinformāciju.

Dažu valstu vietējie likumi nosaka, ka valūta ir jākonvertē izmaksas brīdī Saņēmējam. Šādā gadījumā valūtas kurss un jebkuras summas, kas tiek rādītas vai koplietotas ar jums, var būt pakļautas valūtas kursa svārstībām laikā no brīža, kad veicat pārskaitījumu, līdz brīdim, kad Saņēmējs saņem līdzekļus.

Dažas valstis atļauj veikt izmaksas Saņēmējiem vairākās valūtās. Šādā gadījumā jums jūsu darījuma laikā ir jāizvēlas maksājuma valūta. Dažas valstis ļauj Saņēmējam saņemt izmaksu valūtā, kas atšķiras no jūsu izvēlētās. Šādos gadījumos to var uzskatīt par atsevišķu darījumu, un mēs varam nopelnīt papildu naudu, kad jūsu līdzekļi tiek konvertēti Saņēmēja izvēlētajā valūtā.

3. SMS paziņojumi un maksas. Lai informētu jūs un/vai jūsu saņēmēju par svarīgu informāciju saistībā ar jūsu darījumu, var būt pieejami SMS (īsziņu pakalpojuma) paziņojumi. Mobilo sakaru tīkla operatora piemērotās maksas ir tikai un vienīgi Sūtītāja vai Saņēmēja atbildība. Mēs neesam atbildīgi par jebkādām izmaksām, kas saistītas ar īsziņām. Saskaņā ar piemērojamajiem tiesību aktiem īsziņa tiks nosūtīta uz Sūtītāja un/vai Saņēmēja mobilā tālruņa numuru, kas norādīts Darījuma veikšanas laikā.

4. Konta izmantošana. Jūs, iespējams, varēsiet nosūtīt vai saņemt naudu no vai uz kontu, piemēram, bankas kontu, bankas karti, digitālo maku, rēķinu izrakstītāju vai cita veida kontu (“Konts”). Kontu nodrošina banka vai cits pakalpojumu sniedzējs (“Konta pakalpojumu sniedzējs”), kas var iekasēt no jums papildu maksu. Izmantojot Kontu, jums jāievēro līguma noteikumi ar Konta pakalpojumu sniedzēju. Mēs neuzņemamies atbildību par jebkādām maksām vai problēmām, ko rada Konta pakalpojumu sniedzējs. Ja jūs nosūtāt vai saņemat naudu valūtā, kas atšķiras no jūsu konta valūtas, Konta pakalpojumu sniedzējs var mainīt valūtu pēc sava kursa vai noraidīt pārskaitījumu. Mēs pieņemam maksājumus un pārskaitām naudu tikai uz kontiem, kas tiek izmantoti personīgām, nevis uzņēmējdarbības vajadzībām. Sniedzot darījuma norādījumus, jūs apstiprināt, ka saistītie konti ir paredzēti tikai personīgai lietošanai. Mēs varam izmantot dažādas metodes, lai apstrādātu pārskaitījumus uz kontu vai no tā. Ja jūs mums norādāt nepareizu konta numuru vai citu nepareizu informāciju par kontu, mēs pārskaitīsim naudu uz jūsu norādīto konta numuru. Mēs neuzņemamies atbildību par jebkādām kļūdām, ko pieļāvis Konta pakalpojumu sniedzējs vai jūs. Mēs varam iekasēt no jums papildu maksu par konta izmantošanu; pirms pārskaitījuma veikšanas mēs jūs informēsim par maksām.

Uzsākot Darījumu no konta, jūs (i) apstiprināt, ka esat konta īpašnieks un jums ir tiesības uzsākt Darījumu; un (ii) pilnvarojat mūs veikt elektroniskus debeta un/vai kredīta pārskaitījumus uz jūsu kontu vai apstrādāt un labot kļūdas, ja Darījumu nevar pabeigt.

Mēs neuzņemsimies atbildību, ja: (1) jūsu kontā nav pieejams pietiekami daudz naudas; (2) jūsu konts ir slēgts vai naudas izņemšana ir ierobežota; (3) transakcija pārsniedz Western Union vai jūsu konta sniedzēja noteiktos dolāra vai biežuma ierobežojumus; (4) apstākļi, kas ir ārpus Western Union kontroles (piemēram, plūdi, ugunsgrēks, elektroenerģijas padeves traucējumi, mehāniskas vai sistēmas kļūmes); (5) jūsu konta sniedzējs neciena transakciju, transakcija netiek apstrādāta vai jūsu konta sniedzējs šo transakciju atgriež; (6) jūsu norādījumi tiek zaudēti vai aizkavēti, nosūtot tos uz Western Union; (7) Western Union neapstrādā jūsu darījumu, jo pastāv pamatotas bažas par drošību, vai pakalpojuma iespēja ir pārtraukta vai apturēta, vai Western Union citādi norāda, ka jūsu pieprasījums netiks apstrādāts; un (8) citi izņēmumi, ko pieļauj likums.

5. Maksājuma iespējas. Jūs piekrītat, ka maksāsiet mums Pārskaitījuma maksu un citas piemērojamās maksas par katru Darījumu, ko veicat, izmantojot mūsu pakalpojumus. Maksājuma iespējas atšķiras atkarībā no jūsu Nosūtītāja valsts. Jūs varat norēķināties par Pakalpojumiem, izmantojot Nosūtītāja valstī autorizētu bankas karti vai citas piemērojamas maksāšanas metodes. Jūs varat norēķināties arī skaidrā naudā uz vietas vai izmantojot citas pieejamās maksāšanas iespējas. Kopējā maksājamā summa ir jāsamaksā, pirms mēs apstrādājam Darījumu. Ja jūs maksājat ar bankas karti un mēs nesaņemam atļauju no bankas kartes izdevēja (vai jūsu konta nodrošinātāja Automated Clearing House (“ACH”gadījumā), vai ieskaitītos līdzekļus, izmantojot maksājuma ID), darījums netiks apstrādāts, un līdzekļi netiks pārskaitīti saņēmējam. Katru reizi, kad jūs izmantojat savu bankas karti vai ACH, lai apmaksātu Pakalpojumus, jūs piekrītat, ka mums ir tiesības iekasēt no jūsu norādītās bankas kartes vai attiecīgā konta pilnu summu (ieskaitot pamatsummu, Pārskaitījuma maksu, maksas par valūtas kursiem un jebkuras citas piemērojamās maksas vai nodokļus).

III. DARĪJUMU IZMAKSAS

1. Maksājumu metodes. Mēs piedāvājam Saņēmējam dažādas metodes līdzekļu saņemšanai, tostarp, bet ne tikai, skaidru naudu uz vietas, tieši uz debetkarti, bankas kontu vai digitālo maku, ja pieejams. Dažās valstīs Saņēmējam var būt iespēja izvēlēties līdzekļu saņemšanas metodi, kas atšķiras no Sūtītāja izvēlētās metodes, vai iespēja mainīt izmaksas valūtu. Sūtītājs pilnvaro mūs ievērot Saņēmēja izvēlēto līdzekļu saņemšanas metodi vai izmaksas valūtu, pat ja tā atšķiras no Sūtītāja norādījumiem. Visas izmaksas metodes ir atkarīgas no pieejamības Saņēmēja valstī un Atrašanās vietā.

2. Jūsu Saņēmēja identificēšana. Lai noteiktu, ka persona ir jūsu paredzētais Saņēmējs, kad tā saņem skaidru naudu Atrašanās vietā, jūsu Saņēmējam jābūt gatavam norādīt savu pilnu vārdu, personu apliecinošu dokumentu, jūsu vārdu, MTCN un aptuveno pārskaitījuma summu. Dažās valstīs jūs varat izvēlēties pievienot testa jautājumu. Ja tā darāt, sniedziet atbildi uz jautājumu savam Saņēmējam. Mēs varam arī pieprasīt Saņēmējam sniegt citu informāciju. Darījums tiks izmaksāts personai, kuru mēs uzskatīsim par tiesīgu to saņemt, pamatojoties uz Saņēmēja sniegto informāciju un dokumentiem. Mēs nepārbaudīsim Saņēmēja adreses datus. Mēs varam veikt maksājumu Saņēmējam pat tad, ja jūsu norādītais vārds un jūsu Saņēmēja personu apliecinošajā dokumentā norādītais vārds nedaudz atšķiras (bet mums nav pienākuma veikt maksājumu, ja vārds atšķiras). Ja mēs uzskatīsim, ka sniegtā informācija nav pietiekama, mēs atteiksimies veikt izmaksu, un pārskaitījums būs pieejams, lai jūs varētu to saņemt atpakaļ. Darījumiem, kas nosūtīti uz bankas kontu vai digitālo maku, mēs pārskaitīsim līdzekļus uz jūsu norādīto kontu. Neatbilstības gadījumā starp konta numura īpašnieku (tostarp mobilā tālruņa numuriem vai citu informāciju, ko esat sniedzis Saņēmēja konta identificēšanai) un paredzētā Saņēmēja vārdu, pārskaitījums tiks ieskaitīts jūsu norādītajā konta numurā. Lūdzu, pārbaudiet jūsu sniegto skaitļu precizitāti, jo mēs uz tiem paļaujamies.

IV. IEROBEŽOJUMI

1. Pieejamība. Pakalpojumu pieejamība var atšķirties atkarībā no valsts un jurisdikcijas, un tā var tikt mainīta. Pakalpojuma pieejamību var ietekmēt vairāki faktori, tostarp izvēlētais konkrētais Pakalpojums, jebkādas aizkavētas piegādes iespējas, katram Pakalpojumam piemērojamie īpašie noteikumi, nosūtītā summa, galamērķa valsts, valūtas pieejamība, normatīvie vai patērētāju aizsardzības jautājumi, identifikācijas prasības, piegādes ierobežojumi, atrašanās vietu darba laiks un laika joslu atšķirības.

2. Aizliegtas personas vai darījumi. Saskaņā ar juridiskajām prasībām mums ir aizliegts veikt darījumus ar noteiktām personām vai noteiktās valstīs, un mēs pārbaudām darījumus, salīdzinot tos ar norādīto personu sarakstu, kurām ir piemērotas sankcijas, ko noteikušas dažādas valdības iestādes, tostarp Amerikas Savienotajās Valstīs, Eiropas Savienībā un Apvienotajā Karalistē. Ja jūs vai jūsu Saņēmējs parādāties sarakstā, mēs lūgsim jums papildu informāciju, lai apstiprinātu, ka jūsu vai jūsu Saņēmēja identitāte neatbilst norādītās personas identitātei. Tas var ietvert dzimšanas vietu un datumu, kā arī personu apliecinošus dokumentus. Atbilstības noteikšana aizkavēs Darījumu. Mums var būt nepieciešams iesaldēt jūsu līdzekļus saskaņā ar likumu.

3. Atļautā lietošana. Ja jūs veicat vai mēģināt veikt jebkādu Darījumu, pārkāpjot šos Noteikumus vai mūsu politikas (tostarp politikas, kuru mērķis ir novērst krāpšanu, nelikumīgi iegūtu līdzekļu legalizāciju vai terorisma finansēšanu), vai ja jūs rīkojāties ar krāpniecisku nolūku vai apzināti vai rupji nolaidīgi veicinājāt Darījuma datu ļaunprātīgu izmantošanu, mēs varam daļēji vai pilnībā atteikties sniegt jums mūsu Pakalpojumus; un mums ir tiesības īstenot jebkuras no mūsu tiesībām, kas paredzētas šajos Noteikumos; un/vai ziņot par Darījumu attiecīgajai tiesībaizsardzības iestādei; un/vai pieprasīt jums segt visus zaudējumus un bojājumus par jebkuru neatļautu Darījumu. It īpaši neizmantojiet mūsu pakalpojumus, lai pārkāptu jebkuru likumu, tostarp, bet ne tikai, lai: (i) finansētu terorismu, (ii) atmazgātu naudu, (iii) maksātu telemārketinga speciālistiem (tikai ASV), (iii) iegādātos tabakas izstrādājumus vai (iv) veicinātu jebkādu noziegumu, tostarp krāpšanu, zādzību vai nelegālas azartspēles. Mēs neesam darījumu konta pakalpojumu sniedzējs. Neizmantojiet Pakalpojumus darījumu līdzekļu depozīta glabāšanai. Ja mēs atteiksimies sniegt jums mūsu pakalpojumus (daļēji vai pilnībā) jebkura no iepriekšminētajiem iemesliem dēļ, mēs, ja iespējams, jūs par to informēsim un sniegsim atteikuma iemeslus, ja vien mums to neliedz juridisks vai drošības apsvērums. Izmantojot mūsu Pakalpojumus, jūs apliecināt, ka jūsu un jūsu saņēmēja lietošana ir likumīga, atļauta un nepārkāpj šos noteikumus.

V. KONFIDENCIALITĀTE

Jūsu konfidencialitātes aizsardzība mums ir ļoti svarīga. Lūdzu, pārskatiet Western Union Globālo paziņojumu par konfidencialitāti, lai labāk izprastu mūsu centienus uzturēt jūsu konfidencialitāti, kā arī to, kā mēs izmantojam un atklājam jūsu informāciju.

MĒS NEUZŅEMAMIES ATBILDĪBU PAR ZAUDĒJUMIEM, KAS RADUŠIES PAR ŠĪ NAUDAS PĀRSKAITĪJUMA KAVĒŠANOS, NEAPMAKSĀŠANU VAI NEPIETIEKAMU APMAKSĀŠANU, VAI JEBKURA PAPILDU ZIŅOJUMA NESNIEGŠANU, VAI TAS IZRAISĪTS MŪSU DARBINIEKU VAI PARTNERU NOLAIDĪBAS VAI CITU IEMESLU DĒĻ, KAS PĀRSNIEDZ SUMMU, KAS LĪDZVĒRTĪGA 500 ASV DOLĀRIEM (PAPILDUS NAUDAS PĀRSKAITĪJUMA PAMATSUMMAS UN PĀRSKAITĪJUMA MAKSAS ATMAKSĀŠANAI), IZŅEMOT GADĪJUMUS, KAD TO AIZLIEDZ VIETĒJIE LIKUMI. MĒS NEUZŅEMAMIES ATBILDĪBU PAR NEKĀDIEM NETIEŠIEM, ĪPAŠIEM, NEJAUŠIEM VAI IZRIETOŠIEM ZAUDĒJUMIEM. NESKATOT IEPRIEKŠ MINĒTO, MĒS NEUZŅEMAMIES ATBILDĪBU PAR NEVIENU NOSACĪJUMU VAI GARANTIJU, KO NEVAR IZSLĒGT AR LIKUMU, IESKAITOT NETIEŠU GARANTIJU, KA MĒS SNIEGSIM PAKALPOJUMUS AR PIETIEKAMU RŪPĪBU UN PRASMĒM. VII. SŪDZĪBAS, PIEMĒROJAMIE TIESĪBU AKTI, STRĪDI

1. Piemērojamo tiesību aktu izvēle un strīdu risināšana. Šos Noteikumus un jebkuru Darījumu regulē Nosūtītāja valsts likumi. Jebkuru strīdu saskaņā ar šiem Noteikumiem vai saistībā ar jebkuru Darījumu Sūtītājs var iesniegt attiecīgās valsts tiesās vai citos atzītos strīdu risināšanas forumos, tostarp nododot lietu izskatīšanai neatkarīgai organizācijai vai ombudam. Jebkādu pretrunu gadījumā starp šiem Noteikumiem un piemērojamajiem tiesību aktiem, noteicošie ir piemērojamie tiesību akti.

2. Sūdzības. Ja jums ir sūdzība par mūsu Pakalpojumiem, tostarp par atmaksu, lūdzu, sazinieties ar mums, apmeklējot mūsu Klientu apkalpošanas lapu, kur varat atrast visu informāciju un saziņas iespējas, kas attiecas uz jūsu valsti. Mēs, iespējams, ar jums sazināsimies, ja būs nepieciešama papildinformācija. Mēs rūpīgi izpētīsim šo jautājumu un sniegsim detalizētu atbildi.

VIII. KOMPENSĀCIJA

Jūs piekrītat kompensēt zaudējumus un pasargāt mūs, mūsu piegādātājus, pārdevējus, pakalpojumu sniedzējus un to attiecīgos meitasuzņēmumus, filiāles, amatpersonas, direktorus, aģentus, partnerus, darbiniekus un konsultantus no jebkādām prasībām vai pieprasījumiem, tostarp saprātīgiem advokātu honorāriem, ko izvirza jebkura trešā persona jūsu Pakalpojumu ļaunprātīgas izmantošanas, šo Noteikumu vai jebkura likuma pārkāpuma vai trešās personas tiesību pārkāpuma dēļ vai kas izriet no tā.

IX. ATCELŠANA UN NAUDAS ATMAKSA

Saskaņā ar piemērojamajiem tiesību aktiem jūs varat atcelt Darījumu un saņemt atmaksu, ja vien līdzekļi nav saņemti vai iemaksāti brīdī, kad mēs saņemam jūsu rakstisko pieprasījumu. Atmaksas pieprasījumi, kas saņemti 30 dienu laikā no sākotnējā darījuma uzsākšanas datuma, būs tiesīgi saņemt gan pārskaitījuma summas, gan samaksāto maksu atmaksu. Atmaksas pieprasījumi, kas saņemti 30 dienas pēc sākotnējā darījuma uzsākšanas datuma, būs tiesīgi saņemt tikai pārskaitījuma summas atmaksu. Ja mēs esam iekasējuši nodokļus, tie tiks atmaksāti, izņemot gadījumus, kad likums vai vietējā prakse nosaka citādi.

X. KLIENTU ATBALSTS

Ja Jūs pamanāt kļūdas vai problēmas ar Mūsu Pakalpojumiem vai ja Jūs neesat apmierināts ar Mūsu Pakalpojumiem, lūdzu, apmeklējiet mūsu Klientu apkalpošanas lapu. Mūsu pārstāvis godīgi un nekavējoties izskatīs jūsu problēmu.

XI. CITA INFORMĀCIJA

1. Piešķiršana. Ievērojot piemērojamos tiesību aktus, mēs varam piešķirt šos Noteikumus trešajai personai bez jūsu piekrišanas.

2. Viss līgums. Šie Noteikumi veido pilnīgu vienošanos starp jums un mums un aizstāj jebkādas iepriekšējās vienošanās, kas var pastāvēt starp jums un mums.

3. Valoda. Jūsu ērtībai šie Noteikumi var tikt sniegti vairākās valodās. Ja tiek konstatētas nesakritības, noteicošā ir versija angļu valodā, ciktāl to atļauj piemērojamie tiesību akti.

4. Nav atteikšanās tiesību. Šie Noteikumi joprojām ir spēkā pat tad, ja viens vai vairāki no to punktiem ir spēkā neesoši, nelikumīgi vai neizpildāmi. Pārējo noteikumu spēkā esamība netiek ietekmēta.

5. Nepārvarama vara. Mēs neuzņemamies atbildību par jebkādiem Pakalpojumu sniegšanas traucējumiem vai kavējumiem, ciktāl šādus traucējumus vai kavējumus izraisa apstākļi, kas ir ārpus mūsu saprātīgas kontroles, tostarp, bet ne tikai: izmaiņas piemērojamajos likumos; nepieciešamās fiziskās un tīkla infrastruktūras slēgšana vai nepieejamība; suverēna saistību neizpilde; elektroenerģijas vai interneta padeves pārtraukums; pilsoņu nemieri; karš; un zemestrīce, ugunsgrēks, plūdi vai citas dabas katastrofas.

6. Atdalāmība. Ja kompetentas jurisdikcijas tiesa atzīst kādu šo Noteikumu daļu par spēkā neesošu, nelikumīgu vai neizpildāmu, šāda daļa tiek atdalīta no pārējiem Noteikumiem, kas turpina būt spēkā un izpildāmi pilnā apmērā, ko atļauj likums.

7. Citi Noteikumi. Šos Noteikumus var papildināt noteikumi, kas piemērojami akcijām, ieteikumu programmām, un citi noteikumi, kas piemērojami jums, pamatojoties uz jūsu citu mūsu produktu un pakalpojumu izmantošanu. Ciktāl tiek konstatēts, ka kāds no šiem noteikumiem ir pretrunā ar šiem Noteikumiem, priekšroka dodama šiem Noteikumiem.

Western Union Corretora de Cambio S.A. is an authorized legal representative of Western Union in the country and authorized to operate by the Central Bank of Brazil under number 28996, duly registered with CNPJ No. 13.728.156/0001-35.

The following provision supplements Part B, Section I:

6. Purpose of the transaction. In carrying out the transaction, the client declares to be fully aware of the text contained in the respective receipt, Articles 3 and 4 of Law No. 14,286 of December 29, 2021, and in particular the second and third paragraphs of Article 4, transcribed in this document, as well as BCB Resolution No. 277, of December 31, 2022, which govern this operation. Article 3 of Law No. 14,286, of December 29, 2021: “Article 3 The operations in the exchange market can be carried out only through institutions authorized to operate in this market by the Central Bank of Brazil, in the form of the regulation to be edited by this municipality.” Article 4, §§ 2 and 3 of Law no. 14,286, of December 29, 2021: “§ 2º It Is the responsibility of the client to classify the purpose of the operation in the exchange market, as provided for in the regulation to be edited by the Central Bank of Brazil. § 3º The institutions authorized to operate in the exchange market will provide technical guidance and support, including through virtual means, for customers who need support for the correct classification of purpose of the operation in the exchange market, of which § 2 of this article is addressed.” The client also declares that the Withheld Income Tax at Source (“IRRF”) was not collected in this transaction, because it is an exemption or non-incidence case.

7. Fraud. Customer declares to be aware that Western Union will process, store, share and record your personal data and information for fraud control and prevention purposes, with the aim of ensuring the security of operations. According to current regulations, personal data and information may be shared with companies in your conglomerate, third-party companies, other institutions belonging to the National Financial System, payment institutions and regulatory bodies.

WU WARNS THAT SENDING MONEY TO A PERSON THE SENDER DOES NOT KNOW SHOULD NOT BE CARRIED OUT. INFORMATION AND DETAILS OF MONEY TRANSFERS SHOULD BE SHARED ONLY WITH THE BENEFICIARY.

V. PRIVACY

Your personal data (“Personal Data”) is processed and controlled by Western Union in accordance with the provisions of Federal Law No. 13,709/2018. Western Union collects and uses the personal data provided when sending the transfer of funds, along with other information collected or generated during your relationship with Western Union, in order to provide the contracted services appropriately and in complete manner.

To execute the transaction, Western Union will retain and retain the personal data that the sender provides about the recipient of the transfer of funds (“Third Party Personal Data”). Without the respective personal data and the personal data of third parties, it is not possible to perform the money transfer service. To perform international money transfer transactions through the Mobile Application, using online bank transfers, the customer must enter his personal data in the Mobile Application and without leaving this environment will be redirected to a bank gateway through which he must authorize from his exclusively personal account the corresponding debit. To perform international money transfer transactions through Stage & Pay, the customer may pre-charge the transaction he wishes to carry out through the Mobile Application and then complete it within 24 hours in an Agency paying the amount pre-charged in the Mobile Application.

(v) The date of the Transaction order; and

6. Verification.
We may be required to carry out customer due diligence on You as part of Our know your customer (KYC) policy. We may request for information and documentation prior to or during your use of the Services, including information or documentation relating to Your identity. You agree that Your use of the Services may be subject to Our KYC and verification process.
You agree that We are entitled to check and verify the information You provide, either directly or indirectly through any third party, including through databases. If You fail or refuse to provide the information requested by Us under this section, or if the information You have provided Us with is found to be untrue, inaccurate, or incomplete, We shall be entitled to deny and block Your use of the Services.

7. Execution of Transaction. Notwithstanding any other provision, We may refuse to execute a Transaction if the information provided by You is untrue, inaccurate, or incomplete. In the event of Our refusal to execute the Transaction, We shall inform You regarding the details of such refusal, within 7 seven working days after We have received Your Transaction order.

4. Foreign Exchange Limitation.
Foreign currency transactions, if any, including the purchase or sale of Indonesian Rupiah for foreign currencies, or vice versa, may be subject to certain limitations as determined by Bank Indonesia. 1. Governing Law and Dispute Resolution.
These Terms and any Transaction are governed by the laws of the Send Country. If the Sender is located in Indonesia, any dispute arising out of or in connection with these Terms or any Transaction may be brought before the District Court of Central Jakarta, which shall serve as the primary forum for dispute resolution. Notwithstanding the above, if permitted under applicable law and mutually agreed upon, We may opt to resolve disputes through arbitration, in a forum of the parties’ choosing. In the event of any conflict between these Terms and applicable law, the provisions of the applicable law shall prevail.

The Transaction is not conducted by a bank. Transactions do not involve the acceptance of deposits or term deposits, savings or installment savings. Transactions are not the subject of insurance payment prescribed by Article 53 of the Deposit Insurance Act (Act No. 34 of 1971) or Article 55 of the Agricultural and Fishery Cooperation Savings Insurance Act (Act No.53 of 1973). Western Union has signed and executed a Guarantee Agreement with Mizuho Bank, Ltd. to ensure that all users in Japan are protected by the Performance Protection Funds contained in Article 44 of the Money Transfer Business Act. You have the right to claim onto performance security funds defined in Article 59 of the Money Transfer Business Law (Act No.59 of 2010).

8. Safeguarding rules.
The required security deposit amount is determined on every Saturday at 24:00 midnight New York time (every Sunday at 1:00pm Tokyo time) as the maximum of the required security deposit amounts during the 7-day period of the previous week from Sunday 0:00 midnight New York time to Saturday 24:00 midnight New York time. The required deposit amount will be added to the Guarantee Agreement with Mizuho Bank as described in clause 15.4 above. 9. No Retention by Us. We shall not hold funds received from You which are not used for transactions. With respect to funds received from You via a Payment Method which are deemed not to be used for transactions, We shall return such funds to You or take other measures not to retain such funds. We will only conduct fund transfer transactions of 1,000,000 yen or less.

A person who is not a party to any agreement governed by these Terms has no rights under the Contracts (Rights of Third Parties) Act, Chapter 53B of Singapore.
 
New provision for Part B, Section I:
5. Safeguarding.
Western Union Global Network Pte Ltd is required under the Payment Services Act 2019 (“PSA”) of Singapore to safeguard relevant money (as defined in section 23(14) of the PSA) received from or on the account of its customers. Western Union Global Network Pte Ltd has arranged for the aggregate relevant money of its customers to be safeguarded in a combination of two ways: (a) a certain amount (the “Guaranteed Amount”) is safeguarded by a guarantee given by a safeguarding institution that is a licensed bank in Singapore, which requires the safeguarding institution to pay the Guaranteed Amount in the event of the insolvency of Western Union Global NetworkPte Ltd, in accordance with the applicable requirements of the PSA; and (b) an amount equivalent to all remaining relevant money which exceeds the Guaranteed Amount will be held by Western Union Global Network Pte Ltd on behalf of its customers in a trust account (the “Trust Account”) opened with another safeguarding institution that is also a licensed bank in Singapore. Generally, any relevant money received from a customer of Western Union Global Network that is deposited in the Trust Account will be commingled with relevant money received from other customers of Western Union Global Network Pte Ltd. Consequently, you acknowledge that it is not possible to identify any portion of the relevant money in the Trust Account as specifically belonging to you (nor is it possible to identify whether your relevant money is covered under the Guarantee as opposed to being deposited in the Trust Account) and money in the Trust Account could be withdrawn to meet the obligations of other customers. If the safeguarding institution with which the Trust Account is maintained becomes insolvent, you may be delayed or prevented from recovering your full entitlement to the relevant money.
 
The following provision supplements Part B, Section VI:
We assume liability for the execution of a money transfer order in the event of the fault of an employee or vicarious agent acting on Our behalf, pursuant to the provisions set forth under Singapore law. The liability of Western Union, Western Union affiliates and foreign agents is excluded for cases of negligence. This exclusion does not apply in the case of death, bodily injury or impairment of health, nor in the case of violating major contractual obligations. In the case of violating ancillary contractual obligations through negligence Our liability is limited to replacing the typical and reasonably foreseeable damage up to the maximum amount of SGD 500 (in addition to the transferred amount and the fees charged).
 
The following provision amends Part B, Section VI, Subsection 1:
1. Choice of Law and Dispute Resolution.
These Terms shall be governed and construed in accordance with the laws of the Republic of Singapore and the parties submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
