WESTERN UNION WESTERNUNION.COM SUBSCRIPTION (THE “SUBSCRIPTION”) AND RELATED PROMO CODES (THE “SUBSCRIPTION CODE”) ARE PROVIDED SUBJECT TO THESE TERMS AND CONDITIONS (“Ts&Cs”) AND APPLICABLE LAW. The Subscription is distributed by Western Union Financial Services, Inc., a Colorado corporation (including its affiliates and agents, “Western Union”). Western Union reserves the right to change these Ts&Cs from time to time at its discretion.

DISCOUNTED TRANSFER FEE TRANSACTION: Customers who sign up for the subscription plan receive a discount corresponding to the subscription plan chosen on each transfer they send during the subscription period. Without signing up for the Subscription, customers pay Western Union a fee for each money transfer at the applicable fee then in effect (the “Transfer Fee”). By using a Promo Code, the applicable Transfer Fee for your transaction will be provided when you set-up your transaction, and directly below the Transfer Fee you will be credited a discount equal to the amount according to the subscription plan selected during sign up, resulting in a discounted Transfer Fee transaction. In some cases, you may add additional services for additional fees.

Western Union also makes money from currency exchange. When choosing a money transmitter, carefully compare both transfer fees and exchange rates.

QUALIFYING TRANSFERS: The subscription fee discount is valid only for Western Union Money Transfer® and Western Union® Quick Collect® transactions completed at westernunion.com (“Services”) by a participating customer with a valid Promo Code. The send location of the transfer must be the United States using any of the payment methods westernunion.com allows. The receive location can be any location westernunion.com sends to using any of the pay-out methods westernunion.com allows. Any amount up to $2,999 can be sent as part of the Subscription Plan. The Subscription Plan does not place a limit on the number or frequency of transactions that can be sent by the participating customer, however Western Union reserves the right to limit frequency and number of transactions according to its policies and/or applicable law. Services exclude all Prepaid Services, Convenience Pay, and Western Union Money Transfer® @ ATM transactions. The subscription plan discount does not apply to any charges for changing dollars into foreign currency. Western Union reserves the right to offer promotional discounts that cannot be combined with Subscription reductions. You must pay any applicable taxes on Transfer Fees.

PAYMENT: In consideration for the Subscription, You agree to pay to Western Union a fee for the subscription itself. You can pay using your bank account, a debit or credit card, or WU Pay. You will be invoiced for the subscription fee within 30 days of signing up and the fee is due upon receipt of the invoice. To pay bills with WU Pay, you must instruct your bank to pay WU Pay using your bank’s online bill pay functionality and the payment instructions provided on the WU Pay website. Western Union generally receives funds from your bank account within 1-3 days after you instruct your bank to pay WU Pay. If Western Union does not receive funds from your bank account, the transaction will not be processed and Subscription pricing will not be available to You. Your bank may charge a fee for the bill pay service. Your agreement with Your bank governs use of Your bank account, and You must refer to that agreement to ascertain Your rights and liabilities as an accountholder. For each transfer sent during the subscription period You will pay the applicable fee based on the amount sent, and payment method used. EXPIRATION DATE: To participate you must sign up for a subscription plan by September 30, and the subscription period ends December 31, 2014. A limited number of subscriptions are available for purchase.

REFUNDS & CANCELLATION: If you decide to cancel your subscription, Western Union will freeze your promo code and waive the subscription fee. If your ability to use the Service is denied, you will be refunded for any paid, unused portion of the subscription fee. To obtain a refund for any paid, unused portion of the subscription fee, contact Western Union Customer Support. Qualifying refunds will be made within 45 days of receipt of Your valid written request.

LOST OR STOLEN SUBSCRIPTION CODES: If you suspect someone has copied or stolen your Subscription code, contact Western Union Customer Support immediately. Subscription codes will not be replaced if lost or stolen without the purchaser’s confirmation email as proof of purchase. If you provide proper proof of purchase, a new promo code can be issued to you.

LIMITATIONS: Promo codes cannot be reloaded, resold, bartered, transferred, or redeemed for cash and are void if resold or transferred. Ownership and risk of loss of Your promo code passes to you as soon as we send you the Promo code. We are not responsible for lost or stolen Promo Codes. The Subscription sign up offer cannot be shared reloaded, resold, bartered, transferred, or redeemed for cash. If the Subscriber is not the intended recipient of the offer Western Union will void the offer and a Promo Code will not be offered.

DELIVERY INFORMATION AND REQUIREMENTS FOR SUBSCRIPTION PURCHASERS: Subscription orders may be subject to Western Union policies regarding purchaser verification. If there is a discrepancy, your order may be cancelled. If you have not received your Promo code, please contact Western Union’s Customer Support. Please provide your order number or email address. Western Union is not responsible for Promo Codes that are undeliverable or not received due to your failure to enter your email address accurately. Please check to make sure your email address is correct. Should an email be returned to us due to an inaccurate email address, we may attempt to contact you for a valid email address.

If you have confirmed the your email address, but the Promo Code has not been received within a reasonable period after purchase, these are common reasons delivery may have failed: (a) spam filter blocked email or routed it to a bulk/spam folder, (b) purchaser’s firewall blocked the email, (c) email inbox is over size limit, and (d) invalid email address. If a spam filter is blocking [_______________@Westernunion.com] emails from getting to an inbox, the email options will need to be modified so that [_______________@Westernunion.com] emails are not considered spam. If you need further assistance, contact Western Union Customer Support.

WAIVER/BAR OF CLASS ACTION CLAIMS: All legal actions or claims arising from or relating to a Subscription (“Claim”) shall be brought in the party’s individual capacity only. Neither party shall pursue a Claim as a class representative, a class member or in a class representative action of any kind. Within 72 hours after initiating a transaction, You may opt-out of this provision by calling 1-800-325-6000 and providing certain information, including the Your name and email address.

LIMITATIONS OF LIABILITY: IN NO EVENT SHALL WESTERN UNION BE LIABLE FOR DAMAGES WHETHER CAUSED BY NEGLIGENCE ON THE PART OF ITS EMPLOYEES, SUPPLIERS OR AGENTS OR OTHERWISE, BEYOND THE SUM OF $500, UNLESS YOU HAVE OBTAINED A HIGHER LIABILITY LIMIT BY CALLING THE CUSTOMER SERVICE TELEPHONE NUMBER BELOW AND PAYING AN ADDITIONAL FEE THEREFOR. IN NO EVENT SHALL WESTERN UNION OR ITS AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR THE LIKE.

INDEMNITY: You agree to indemnify, defend and hold harmless Western Union, and all its officers, directors, owners, agents, employees, affiliates, licensors, licensees and third party service providers (collectively, the “Indemnified Parties”) from and against any and all losses, damages, liabilities, and claims and all fees, costs, expenses of any kind related thereto (including, without limitation, reasonable attorneys fees) incurred by the Indemnified Parties in connection with any claim arising out of, based upon or resulting from (i) Your access to and/or use of the Western Union website or Subscription codes including, without limitation, the Services; and/or (ii) Your violation of these Terms and Conditions. Western Union reserves the right, at its own expense, to assume the exclusive defense and control of any matter brought by someone other than You or Western Union subject to indemnification by You. You shall not in any event settle any such matter without the written consent of Western Union.

PRIVACY POLICIES: Western Union may disclose Your personal information to third parties as explained in Western Union’s Privacy Statement; to obtain a copy, ask Your Western Union Agent, visit www.westernunion.com, or call 1-800-562-2598. Information disclosed may include Your financial background, Your contact information, Your identification, information about Your transactions with us and other information relating to financial matters. Recipients may include financial institutions, retailers, our service providers, government agencies and direct marketers. You may direct us to limit certain disclosures of your information to some of these parties. Your choice to limit certain disclosures will apply until you tell us to change your choice or we delete your data from our systems. ELECTRONIC RECORDS POLICY: Western Union may provide information to you electronically. Before using electronic and related services provided by Western Union (“Services”), you must review and consent to Western Union’s Privacy Statement  as well as the E-Sign Disclosure and Consent Notice. If you choose not to consent to this policy or you withdraw your consent, you cannot use our Services. Your consent to this policy may also apply to our affiliates’ products or services at our affiliates’ sole discretion. By using our Services you hereby consent to this policy and affirm that you have access to the hardware and software requirements identified in the Policy. GENERAL: These Ts&Cs, together with all items incorporated by reference, embodies the entire understanding among the parties regarding the Subscription and supersedes all prior understandings regarding the Subscription. Western Union has the right to assign these Ts&Cs to any party, at any time without Your consent. These Ts&Cs are governed by Colorado law without regard to conflicts of law rules. If an Agreement provision is found invalid, remaining provisions shall be valid. Sign up for the Subscription Fee and these Ts&Cs are directed solely to persons 18 and over. The English language version controls if there is an inconsistency between English and non-English Agreement versions. You represent that your use of the Subscription code does not violate: (a) any law, including, without limit, laws relating to money laundering, illegal gambling activities, support for terrorist activities or fraud; and/or (b) these Ts&Cs. Information provided to Western Union shall be truthful and complete. You shall indemnify Western Union and its Agents for all losses of any kind (including but not limited to attorney fees) arising out of any breach by You of these Ts&Cs. Western Union reserves the right to change the Subscription plan and/or Services without notice. Western Union and its Agents may refuse to provide Services to any person.
