WESTERN UNION® “MONEY MOVES” OFFICIAL RULES
PROMOTION PERIOD: The Western Union® “Money Moves” (the “Promotion”) sponsored by Western Union Financial Services, Inc. (the “Sponsor”) begins at 9:00:00 AM Mountain Time on February 15, 2019 and ends at 11:59:59 PM Mountain Time on March 25, 2019 (the “Promotion Period”).
ELIGIBILITY: The Promotion is open only to legal residents aged eighteen (18) or older who reside in the state of Colorado and possess a valid social security or tax ID card.
Employees of Western Union Financial Services, Inc. (“Sponsor”), its affiliates and subsidiaries, Western Union Agents and Sub-agents, vendors, promotion agencies, Kroenke Sports & Entertainment, LLC, Altitude Sports & Entertainment, LLC, the Pepsi Center, the Denver Nuggets, the National Basketball Association and its member teams, NBA Properties, Inc., NBA Media Ventures, LLC, and each of their respective parents, affiliated companies, subsidiaries, licensees, divisions, members, teams, affiliated leagues and any and all other companies associated with the Promotion (collectively “Released Parties”) as well as the immediate family (spouse, parents, siblings and children, regardless of where they reside) and the household members of each employee, are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and the Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize and/or award is contingent upon fulfilling all requirements set forth herein.
ALL SEMI-FINALISTS MUST APPEAR AT THE PEPSI CENTER IN DENVER, CO ON MARCH 25,2019 AND MEET AT A TIME AND PLACE DESIGNATED BY THE SPONSOR.
HOW TO ENTER: ON TWITTER OR INSTAGRAM: Using a profile set to public, create a post and include a video of your best trick shot or dunk using the hashtag #WUMoneyMovesContest. ON FACEBOOK: Create a public post and post a video of your best trick shot or dunk using the hashtag #WUMoneyMovesContest to the Western Union Facebook page. Regardless the platform of entry, trick shot or dunk must be able to be replicated, without any props, on a basketball court at a time and place to be determined by the Sponsor. One (1) entry is allowed per person, regardless of the form of entry.
VIDEO SUBMISSION GUIDELINES, INDEMNIFICATION, REPRESENTATIONS & WARRANTIES REGARDING ENTRIES:
- Must comply with all file size and type requirements of the social media platform where entry is submitted.
- If any photo or video is taken, in whole or in part, by an individual other than the entrant, entrant represents and warrants that she/he has permission from such individual to submit the photo(s) or video(s) as part of his/her entry.
- All submissions must be original, composed entirely by entrant, and must not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity.
- The entrant must be the main subject of any photos(s) or video(s) included as part of the entry.
- If any person other than the entrant is depicted in any photo or video, the entrant is responsible for obtaining any necessary permission for use of each such person’s name or likeness.
- Entry must not have been previously published, released or distributed in any form;
- Entries that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, not in keeping with Sponsor’s image or entries that otherwise contain inappropriate content or objectionable material as determined by Sponsor in its sole discretion will be disqualified.
By submitting an entry, entrant grants to the Released Parties a non-exclusive, perpetual, irrevocable worldwide, royalty-free license to use the entry for purposes of the Promotion and for other commercial and non-commercial purposes in all media now know or hereafter developed.
In consideration of the opportunity to participate in the Promotion and to be considered as a potential prize winner, each entrant, on behalf of all persons and entities possessing rights in an entry, hereby: (a) represents and warrants the entrant has the authority to grant the permission and rights for publicity and for commercial and non-commercial uses of any submitted entry, and that no other permission will be required to grant such rights; (b) releases Released Parties from any and all claims or liability arising out of any such authorized use; (c) agrees to indemnify and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or related to any breach of any provision of these Official Rules.
AVAILABLE PRIZES & SELECTION OF WINNERS: There are a total of sixteen (16) prizes with a total approximate retail value of $4,200 available to be awarded during the Promotion Period. Semi-Finalist Prizes: Fifteen (15) Denver Nuggets jerseys. ARV $120. Grand Prize: One (1) grand prize package that includes the opportunity to take the Western Union First Shot before the Denver Nuggets vs. San Antonio Spurs game at Pepsi Center in Denver, CO at 7:00pm MT on April 3, 2019. Winner will receive two (2) courtside tickets to the same game with access to Club Lexus for two (2) and one (1) parking pass. ARV $2,400.
Judging of videos will be conducted by Sponsor representatives and/or judges who will select a group of up to approximately fifteen (15) semi-finalists. Selection of the semi-finalists will occur no later than March 15, 2019. Semi-finalists will be selected, based on skill alone, applying the following criteria with equal weight to each: Creativity, originality and quality of overall concept.
Potential semi-finalists will be notified, on or about March 18, 2019 via the social media platform hosting the entry. Sponsor reserves the right to select an alternative potential semi-finalist if no response is received to a verification notice within 48 hours.
Judging of semi-finalists will be conducted by Sponsor representatives and/or judges who will determine up to approximately five (5) finalists. Selection of the finalists will occur on March 25, 2019 by having each semi-finalist perform their best trick shot or dunk within a two (2) minute window. Finalists will be selected, based on skill alone, applying the following criteria with equal weight to each: Creativity, originality, quality of overall concept.
Judging of finalists will be conducted by Sponsor representatives and/or judges who will determine one (1) grand prize winner. Selection of the grand prize winner will occur on March 25, 2019 by having each finalist perform their best trick shot or dunk within a two (2) minute window. The grand prize winner will be selected, based on skill alone, applying the following criteria with equal weight to each: Creativity, originality, quality of overall concept.
No substitution or transfer of any prize permitted, except that Sponsor may in its discretion substitute a prize of equal or greater value.
DISQUALIFICAIONS: Sponsor reserves the right to disqualify and/or exclude, in its sole and absolute discretion, any person from any portion of the Promotion for any reason, including misrepresentation of any fact to Sponsor, violation of any provision in these Official Rules, tampering with the application, submission or judging process, or in Sponsor’s determination, that an entrant or any submitted material is not appropriate to the image of the Sponsor’s brand. Discovery of any conduct by any entrant that may be deemed criminal or which could bring Sponsor into public ridicule, as determined by Sponsor in its sole and absolute discretion, is grounds for disqualification.
GENERAL RULES: All entrants agree to release, discharge and hold harmless the Released Parties and Facebook from and against any and all liability (including damages caused or claimed to be caused) arising out of participation with the Promotion. All applicable taxes on prize/award and any expenses relating to the acceptance/use of prize not specified herein are the sole responsibility of winner. Potential winners or finalists may be required to confirm in writing the following: a) releasing, discharging and holding harmless the Released Parties from and against any and all liability (including damages caused or claimed to be caused) arising out of participation and/or acceptance/use of prize or award; b) use of winner’s likeness in perpetuity throughout all media; c) eligibility with these Official Rules. Entrants agree to be bound by the Official Rules and the judging decisions of the Sponsor, which are final. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, including a winners list, unless prohibited by law. Claims may not be resolved through any form of class action. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. If for any reason, including but not limited to an administrative, printing, production or other error or due to incorrect announcements of any kind, more potential winning notifications are distributed or more prizes and/or awards are claimed than are intended to be awarded for any prize/award level according to these Official Rules, intended prizes and/or awards will be awarded in a random drawing from among all verified claims received for that prize/award level. In no event will Sponsor be obligated to award more than the stated number of prizes and/or awards. Unclaimed prizes will not be awarded or transferred unless required by local law. In the event of a printing, production or other error neither the Sponsor nor its respective agents and agencies shall have any liability. This Promotion and these Official Rules shall be interpreted in accordance with the laws of the territory where the Promotion is executed. Jurisdiction and venue shall be solely within the territory where the Promotion is executed.
PRIVACY: The personal information you submit in connection with this Promotion is collected by Sponsor and will be subject to Sponsor’s Privacy Statement (“Statement”). Sponsor may disclose your personal information to third parties as explained in the Statement. Information disclosed may include financial background; identification, such as name and address; transaction information; and other information relating to financial matters. Recipients may include financial institutions; retailers; companies that process transactions or provide other services for Sponsor; government agencies; and direct marketers. You may opt out of (direct Sponsor not to make) certain disclosures. If you do not opt out, Sponsor will assume that you agree that your information may be used as the Statement describes. NOTICE TO ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Sponsor and its agents are not responsible for any (i) incorrect announcements of any kind, (ii) technical hardware or software failures of any kind, including any injury or damage to any person’s computer related to or resulting from participating in or experiencing any materials in connection with the promotion, (iii) lost or unavailable network connections, or (iv) failed, incomplete, garbled, or delayed computer transmission that may limit a user’s ability to participate in the Promotion. The Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user’s Internet service provider and/or email client or for insufficient space in user’s email account to receive email messages. Sponsor and its agencies are not responsible for Entries not received due to lost, failed delayed or interrupted connections or miscommunications, or to other electronic malfunctions, delays, or errors of any kind in the transmission or receipt of Entries. Sponsor is not responsible for incorrect or inaccurate Entry information, whether caused by any human or technological error that may occur in the processing of Entries in this Promotion. Any other attempted form of Entry not specified herein is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. The Sponsor reserves the right to cancel or modify the Promotion if fraud, misconduct, or technical failures destroy the integrity of the Promotion or if a computer virus, bug, or other technical problem corrupts the administration or security of the Promotion as determined by the Sponsor in its sole discretion. Proof of submitting entries will not be deemed to be proof of receipt by the Sponsor. The Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
