Western Union® Value Pack Terms and Conditions WESTERN UNION VALUE PACK VOUCHERS AND RELATED PROMO CODES (THE "VOUCHERS") ARE PROVIDED SUBJECT TO THESE TERMS AND CONDITIONS ("Ts& cS") AND APPLICABLE LAW. The Vouchers are distributed by Western Union Financial Services, Inc., a Colorado corporation (including its affiliates and agents, "Western Union"). Western Union reserves the right to change these Ts & Cs from time to time in its discretion.

TRANSFER FEE FREE TRANSACTION: Each Voucher is good for one free (i.e. no Transaction Fee) money transfer. Without Vouchers, customers pay Western Union a fee for each Service transaction at the applicable rate then in effect (the "Transfer Fee"). By using a Voucher promo code, the applicable Transfer Fee for Your transaction will be provided when you set-up your Service transaction, and directly below the Transfer Fee you will be credited a discount equal to the amount of the Transfer Fee, resulting in a zero Transfer Fee transaction. In some cases, You may add additional services for additional fees. Valid only in TX, NY, GA, IL, NJ, NC, PA, Mass, WA and Mich.

WESTERN UNION ALSO MAKES MONEY WHEN IT CHANGES YOUR DOLLARS INTO FOREIGN CURRENCY. Vouchers are valid only for Western Union Money Transfer® and Western Union® Quick Collect® transactions completed at westernunion.com (“Services”). Excludes all Prepaid Services, Convenience Pay, and Western Union Money Transfer® @ ATM transactions. Please see www.westernunion.com for additional Terms and Conditions that apply to the Services. Western Union reserves the right to offer promotional discounts that cannot be combined with Voucher Transfer Fee reductions. You must pay any applicable taxes on undiscounted Transfer Fees. Funds may be delayed or services unavailable based on certain factors, including the amount sent, destination country, currency availability, regulatory issues, identification requirements, agent location hours, differences in time zones, and selection of delayed delivery options. PAYMENT: In consideration for the Vouchers, You agree to pay to Western Union a fee for each value pack You purchase. You may only pay for a Voucher pack using Western Union’s WUPay option. The Value Pack purchase price is due and payable before Western Union processes your order. To pay bills with WUPay, you must instruct your bank to pay WUPay using your bank’s online billpay functionality and the payment instructions provided on the WUPay website. Western Union generally receives funds from your bank account within 1-3 days after you instruct your bank to pay WUPay. If Western Union does not receive funds from your bank account, the transaction will not be processed and Vouchers will not be provided to You. Your bank may charge a fee for the bill pay service. Your agreement with Your bank governs use of Your bank account, and You must refer to that agreement to ascertain Your rights and liabilities as an accountholder. EXPIRATION DATE: Vouchers not utilized before March 31th, 2014, will be cancelled.

REFUNDS: If your ability to use a Service is denied, you may return your unused Vouchers, in which case you will be refunded the per Voucher amount (the full amount paid for your Voucher pack divided by the number of Vouchers in the pack) for each unused Voucher. To obtain a refund, contact Western Union Customer Support. Qualifying refunds will be made within 45 days of receipt of Your valid written request. LOST OR STOLEN VOUCHERS: If you suspect someone has copied or stolen your Voucher codes, contact Western Union Customer Support immediately. Vouchers will not be replaced if lost or stolen without the purchaser's confirmation email as proof of purchase. If you provide proper proof of purchase, any unused Vouchers can be re-issued to you with new Voucher codes. LIMITATIONS: Vouchers cannot be reloaded, resold, bartered, transferred for value, or redeemed for cash and are void if resold or transferred for value. Ownership and risk of loss of Vouchers passes to you as soon as we send you the Voucher codes. We are not responsible for lost or stolen Vouchers.

DELIVERY INFORMATION AND REQUIREMENTS FOR VOUCHER PURCHASERS: Voucher orders may be subject to Western Union policies regarding purchaser verification. If there is a discrepancy, your Voucher order may be cancelled and the amount paid for unused Vouchers refunded to you. If you have not received your Voucher codes, please contact Western Union’s Customer Support. Please provide your order number or email address. Western Union is not responsible for Vouchers that are undeliverable or not received due to your failure to enter your email address accurately. Please check to make sure your email address is correct. Should an email be returned to us due to an inaccurate e-mail address, we may attempt to contact you for a valid email address. If you have confirmed the your email address but the Voucher has not been received within a reasonable period after purchase, these are common reasons \delivery may have failed: (a) spam filter blocked email or routed it to a bulk/spam folder, (b) purchaser’s firewall blocked the email, (c) e-mail inbox is over size limit, and (d) invalid email address. If a spam filter is blocking [_______________@Westernunion.com] emails from getting to an inbox, the email options will need to be modified so that [_______________@Westernunion.com] emails are not considered spam. WAIVER/BAR OF CLASS ACTION CLAIMS: All legal actions or claims arising from or relating to a Voucher ("Claim") shall be brought in the party's individual capacity only. Neither party shall pursue a Claim as a class representative, a class member or in a class representative action of any kind. Within 72 hours after initiating a transaction, You may opt-out of this provision by calling 1-800-325-6000 and providing certain information, including the Your name and email address.
LIMITATIONS OF LIABILITY: IN NO EVENT SHALL WESTERN UNION BE LIABLE FOR DAMAGES WHETHER CAUSED BY NEGLIGENCE ON THE PART OF ITS EMPLOYEES, SUPPLIERS OR AGENTS OR OTHERWISE, BEYOND THE SUM OF $500 (in addition to refunding the purchase price for unused Vouchers), UNLESS YOU HAVE OBTAINED A HIGHER LIABILITY LIMIT BY CALLING THE CUSTOMER SERVICE TELEPHONE NUMBER BELOW AND PAYING AN ADDITIONAL FEE THEREFOR. IN NO EVENT SHALL WESTERN UNION OR ITS AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR THE LIKE.

INDEMNITY: You agree to indemnify, defend and hold harmless Western Union, and all its officers, directors, owners, agents, employees, affiliates, licensors, licensees and third party service providers (collectively, the "Indemnified Parties") from and against any and all losses, damages, liabilities, and claims and all fees, costs, expenses of any kind related thereto (including, without limitation, reasonable attorneys fees) incurred by the Indemnified Parties in connection with any claim arising out of, based upon or resulting from (i) Your access to and/or use of the Western Union website or Vouchers including, without limitation, the Services; and/or (ii) Your violation of these Terms and Conditions. Western Union reserves the right, at its own expense, to assume the exclusive defense and control of any matter brought by someone other than You or Western Union subject to indemnification by You. You shall not in any event settle any such matter without the written consent of Western Union. PRIVACY POLICIES: Western Union may disclose Your personal information to third parties as explained in Western Union's Privacy Statement; to obtain a copy, ask Your Western Union Agent, visit www.westernunion.com, or call 1-800-562-2598. Information disclosed may include Your financial background, Your contact information, Your identification, information about Your transactions with us and other information relating to financial matters. Recipients may include financial institutions, retailers, our service providers, government agencies and direct marketers. You may direct us to limit certain disclosures of your information to some of these parties. Your choice to limit certain disclosures will apply until you tell us to change your choice or we delete your data from our systems. ELECTRONIC RECORDS POLICY: Western Union may provide information to you electronically. Before using electronic and related services provided by Western Union ("Services"), you must review and consent to Western Union's Electronic Records Policy. If you choose not to consent to this policy or you withdraw your consent, you cannot use our Services. Your consent to this policy may also apply to our affiliates' products or services at our affiliates' sole discretion. By using our Services you hereby consent to this policy and affirm that you have access to the hardware and software requirements identified in the Policy. GENERAL: These Ts & Cs, together with all items incorporated by reference, embodies the entire understanding among the parties regarding the Vouchers and supersedes all prior understandings regarding the Vouchers. Western Union has the right to assign these Ts & Cs to any party, at any time without Your consent. These Ts & Cs are governed by Colorado law without regard to conflicts of law rules. If an Agreement provision is found invalid, remaining provisions shall be valid. Sale of Voucher packs and these Ts & Cs are directed solely to persons 18 and over. The English language version controls if there is an inconsistency between English and non-English Agreement versions. You represent that your use of Vouchers does not violate: (a) any law, including, without limit, laws relating to money laundering, illegal gambling activities, support for terrorist activities or fraud; and/or (b) these Ts & Cs. Information provided to Western Union shall be truthful and complete. You shall indemnify Western Union and its Agents for all losses of any kind (including but not limited to attorney fees) arising out of any breach by You of these Ts & Cs. Western Union reserves the right to change the Vouchers and/ or Services without notice. Western Union and its Agents may refuse to provide Services to any person.
